Affiliate Program

Effective from: October 22, 2024

1. Introduction

This document establishes the terms and conditions governing participation in Monitorator's affiliate program ("the Program"). By participating in the Program, you agree to comply with these terms and conditions.

2. Eligibility

2.1. To participate in the Program, you must:

  • Be of legal age in your jurisdiction
  • Have an active Monitorator account
  • Comply with all applicable laws and regulations
  • Provide accurate and up-to-date information

2.2. Monitorator reserves the right to:

  • Reject any affiliate application
  • Terminate any affiliate's participation
  • Modify eligibility requirements

3. Commission Structure and Benefits

3.1. Benefits for Referred Users:

  • 15% discount on their first payment (monthly or annual)
  • Discount is automatically applied when using the referral link
  • Cannot be combined with other promotions

3.2. Affiliate Commissions:

  • 50% of platform revenue for each referred user
  • Commissions are recurring while the referred user maintains their subscription
  • Commissions are calculated on the price after any discounts

4. Validity Period and Attribution

4.1. Cookie Period:

  • Referral code is valid for 30 days from the first click
  • If the user registers within this period, they will be permanently linked to your affiliate code
  • No retroactive attributions allowed

4.2. Referral Attribution:

  • Attribution is based on last click
  • System automatically records referrals through unique codes
  • Self-referrals are not allowed

5. Tax Requirements and Payments

5.1. Minimum Requirements:

  • Minimum €150 accumulated to request payment
  • Unclaimed funds remain in the affiliate's account

5.2. Payment Process:

  • Payment requests must be made through the contact form
  • Valid tax documentation required to process payments
  • Payments will be processed within 30 days of request

5.3. Payment Documentation:

EU Affiliates:

  • Valid VAT number (if applicable)
  • VAT invoice according to European regulations
  • Business identity documentation

Non-EU Affiliates:

  • Tax documentation according to country of residence
  • Tax residence certificate
  • Complete international banking information

5.4. Tax Obligations:

  • Affiliate is responsible for declaring and paying their own taxes
  • Affiliate income must be declared according to affiliate's local legislation
  • Monitorator is not responsible for individual affiliate tax compliance

5.5. VAT Treatment:

EU Transactions:

  • Reverse charge mechanism applies when applicable
  • Affiliates with valid VAT numbers must issue invoices according to EU regulations

Non-EU Transactions:

  • Specific regulations of each country will apply
  • Affiliate must comply with local tax obligations

6. Prohibited Practices and Obligations

6.1. Expressly Prohibited Activities:

  • Using advertising on Google AdWords, Facebook Ads, or other platforms using the Monitorator brand
  • Spam in any form or medium
  • Creating websites that imitate or copy Monitorator
  • Using deceptive or fraudulent marketing techniques
  • Creating false or multiple accounts
  • Bidding on brand keywords
  • Sending unsolicited mass emails
  • Cookie stuffing or tracking manipulation
  • Promotion on sites with illegal or inappropriate content

6.2. Monitorator's Discretion:

  • Monitorator reserves the right to determine if any practice, although not explicitly listed, is inappropriate or harmful
  • Monitorator's decision on the suitability of marketing practices is final
  • Monitorator may request immediate cessation of any promotional practice

6.3. Affiliate Obligations:

  • Maintain program information confidentiality
  • Comply with all applicable privacy laws
  • Not share referred user data

7. Intellectual Property and Brand Usage

7.1. Permitted Use:

  • Affiliates may use Monitorator's name and logo in their promotions
  • All usage must be accompanied by the clear statement "Monitorator Affiliate"
  • Usage allowed on blogs, social media, and personal websites

7.2. Restrictions:

  • Prohibited to present oneself as an employee or official representative of Monitorator
  • Prohibited to modify logos or brand materials
  • Prohibited to register domains that include the Monitorator brand

7.3. Affiliation Declaration:

  • Must be visible and clear in all communications
  • Required text example: "This is a Monitorator affiliate link"
  • Declaration must appear near the link or promotional material

8. Consequences of Non-Compliance

8.1. Warning Process:

  1. First violation: Written warning
  2. Second violation: 30-day temporary suspension
  3. Third violation: Permanent program termination

8.2. Serious Violations:

  • Serious violations will result in immediate termination without prior warning
  • All accumulated unpaid funds will be retained
  • Permanent ban from program participation

8.3. Fund Retention:

  • Monitorator reserves the right to withhold any pending payment in case of suspected fraud
  • Accumulated funds will be cancelled in case of terms violation
  • No commission payments for those generated through prohibited practices

9. Disputes and Resolution

9.1. Resolution Process:

  • All disputes must be communicated in writing through the contact form
  • Maximum deadline to submit a claim is 60 days from the incident
  • Monitorator commits to respond within 30 business days maximum

9.2. Procedure:

  1. Formal submission of claim with evidence
  2. Initial review by affiliate team
  3. Detailed case investigation
  4. Final decision communicated in writing

10. Modifications and Termination

10.1. Monitorator reserves the right to:

  • Modify these terms at any time
  • Adjust commission rates with prior notice
  • Terminate the affiliate program

10.2. Termination:

  • Either party may terminate the relationship with 30 days notice
  • Pending commissions will be paid according to current terms
  • Serious non-compliance may result in immediate termination
